TikTok is going on the counterattack after a law was recently passed in the US state of Montana that bans the app there. On Monday, TikTok filed a lawsuit against the state, calling its move illegal. The website informed about it TechCrunch.

The law, signed into law by Montana Gov. Greg Gianforte on May 17, bans TikTok and orders app stores in the state to make it unavailable. Stores that would violate the regulation would be fined $10 (less than CZK 000) for each day of violation. According to Gianforte, the law, which goes into effect on January 220 of next year, was passed to "protect the personal and private data of Montanans from the Chinese Communist Party."

In its lawsuit, TikTok says the ban violates the First Amendment of the US Constitution and that it is based on "baseless speculation." It also claims that the state of Montana does not have the right to ban the app because national security and foreign affairs are matters that must be dealt with by the federal government. "We're challenging Montana's unconstitutional ban on TikTok to protect our business and the hundreds of thousands of TikTok users here." the company said on Monday declaration. "Based on an exceptionally strong set of precedents and facts, we believe our case will stand." she added.

Despite the US government's efforts to label TikTok a national security threat, the company says it does not share any user data with the Chinese government, nor has it been asked to. She also outlined earlier ways, how it protects the data it collects, especially the "restricted" data it collects from users in the US. TikTok is a big global issue and it may well happen that Montana has just started and a wave of many bans may break down, which will jump from the US to Europe as well. Even if TikTok can defend itself as it wants, certain controversies are simply associated with it and probably will continue to be, so it can only be a matter of not if, but when we will have to say goodbye to this platform for good.
